    Many family law matters are modifications of prior divorces, paternity actions or suits affecting the parent-child
    relationship. Specifically, the modification actions are suit to modify conservatorship of children, possession or
    parenting time schedules of children, or previous orders for child support. A court may not modify orders for
    division of property from a final divorce decree.

    Modification of conservatorship or child custody and possession or parenting time schedules may not be legally
    granted simply because one party wishes to change the prior orders. In order to modify these child-related
    provisions, there must be a “substantial change in circumstances” of at least one of the parents or the child.
    Further, the change sought by the filing parent must also be proven to be in the “best interest” of the child.

    A court may modify a previous child support order in most instances only when certain conditions are first met:
   (1) if it has been three or more years since the last child support order was rendered and the monthly child
   support amount differs by 20% or $100 from the amount that would be awarded when statutory guideline child
   support is calculated or (b) if there has been a material and substantial change in the circumstances of the child
   or one of the parents since the last order was rendered.
